Terms & Conditions

These Terms and Conditions ("Terms") govern the use of the free-to-play online game "World of Pharaos" (the "Game"), operated by VidiScope GmbH, Römerstr. 27, 89250 Senden, Germany (the "Operator"), including the purchase of Taler packs. By registering a game account, the user accepts these Terms.

Section 1 – Scope and Provider

These Terms apply to the use of World of Pharaos by registered players. The provider and operator is VidiScope GmbH, Römerstr. 27, 89250 Senden, Germany (contact details in the Legal Notice).

Section 2 – Subject Matter

World of Pharaos is a free-to-play browser-based strategy game set in ancient Egypt. There is no entitlement to any particular availability or functionality of the Game. The Operator may change, extend, or remove content, features, and game mechanics for a valid reason (e.g. game balance, security, technical development, changes in the law); Section 14a applies to the discontinuation of the Game as a whole.

The Game can be played without any purchase. Optionally, the user may purchase the virtual in-game currency "Taler" in fixed packs for a fee (one-time purchase, no subscription). Sections 14, 14a and 15 additionally apply to such purchases.

Registering a game account constitutes an offer by the user to conclude the terms-of-use agreement. The agreement is only formed once the Operator activates the account. There is no entitlement to conclusion of the agreement; the Operator may decline a registration without stating reasons.

Section 3 – Registration and Account

Participation requires registration with a nickname, a valid email address, and a self-chosen password. Users are obligated to provide truthful information and to keep their password confidential.

Only one account per player and game world is permitted. Trading, selling, or transferring accounts to third parties, whether for payment or free of charge, is not permitted.

Section 4 – Minimum Age

Participation in World of Pharaos is permitted from a minimum age of 16 years. Minors between 16 and 17 years of age may only participate with the consent of their parent or legal guardian. By registering, the user confirms that they have reached the required minimum age or, if a minor, that consent of a parent or legal guardian has been obtained.

Section 5 – Rules of Conduct

In particular, cheating, the use of bots, scripts, or other automated tools, as well as creating or using multiple accounts ("multi-accounts") and account sharing are prohibited.

Insulting, discriminatory, pornographic, racist, or otherwise unlawful content is prohibited in chats, messages, alliance names, and other user-generated content. Users are solely responsible for the content of communications between users.

Section 6 – Virtual Goods and Game Progress

All virtual items, resources, buildings, troops, and other game progress are virtual goods with no independent monetary value. Users do not acquire ownership of, or any right to payout or compensation for, such items. All rights to virtual goods remain with the Operator.

There is no guarantee of success: users have no entitlement – including after purchasing Taler – to any particular game outcome, leaderboard position, or the permanent retention of items earned in the game. Virtual goods, including Taler, are not the user's property and cannot be paid out, transferred, or exchanged for real money. The user's rights under Section 14a and under the statutory provisions on digital products remain unaffected.

Section 7 – Sanctions

In the event of violations of these Terms or the game rules, the Operator may, depending on the severity of the violation, issue warnings, restrict individual features, or temporarily or permanently suspend or delete the account. There is no entitlement to restoration of a suspended or deleted account.

Section 8 – Availability and Liability

Use of World of Pharaos is free of charge; there is no entitlement to uninterrupted availability. The Operator is liable without limitation for intent and gross negligence, for injury to life, body, or health, and under the German Product Liability Act. In all other cases of ordinary negligence, the Operator is only liable for breach of material contractual obligations (cardinal obligations), limited to the damage typically foreseeable under the contract.

If purchased Taler that have not yet been used are lost due to a technical fault or data loss for which the Operator is responsible, the Operator will re-credit them. Otherwise, the Operator is liable for the loss of game data or game progress only in accordance with the preceding paragraph. Users are advised not to disclose sensitive personal data within the game (e.g., in chats).

The Operator aims to provide the Game with high availability on a yearly average; scheduled maintenance windows and outages at service providers engaged by the Operator (e.g. hosting) are excluded from this target. No guaranteed availability beyond this target exists.

To the extent the Game is used free of charge, claims for defects are limited. For purchased Taler, the statutory rights regarding defects in digital products (Sections 327 et seq. BGB) apply without restriction. Defects should be reported to the Operator in text form (e.g. by email to office@vidiscope.com) so that they can be remedied. Immaterial impairments of the free game features do not constitute a defect.

Section 9 – Termination

Users may end their participation at any time by deleting their account; see Section 14a for the consequences for unused Taler. The Operator may discontinue World of Pharaos, in whole or in part, upon reasonable prior notice; discontinuation of the Game as a whole will be announced at least three months in advance (Section 14a).

Section 10 – Changes to these Terms

The Operator reserves the right to amend these Terms with effect for the future. Users will be notified of changes in text form (e.g. by email or via an in-game notice) at least six weeks before they take effect. Users have the right to object to the change within this period. If the user does not object in time, the amended Terms are deemed accepted; the user will be specifically informed of this consequence of silence as well as of their right to object in the notification of changes.

Section 11 – Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer-protection provisions of the country in which the user has their habitual residence, as well as the statutory venue for consumers, remain unaffected.

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.

The Operator is neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

Section 12 – Force Majeure

The Operator is not liable for outages, delays, or impairments of game operations resulting from circumstances beyond its control, in particular force majeure, natural events, strikes, official orders, failures of internet or power supply, and disruptions at service providers engaged by the Operator (e.g. hosting providers). The affected obligations are suspended for the duration and to the extent of the disruption.

Section 14 – Taler Packs: Offer, Conclusion of Contract, and Payment

The Operator offers registered users the virtual in-game currency "Taler" in fixed packs. The packs (amount of Taler) and prices displayed in the shop at the time of the order apply. All prices are final prices including statutory VAT. Each purchase is a one-time purchase; it does not create a subscription or any recurring payment obligation.

Conclusion of contract: The user selects a pack in the shop, gives the consent described in Section 15, and is redirected to Stripe's payment page via the "Continue to payment" button. There, the pack, amount of Taler, and total price are displayed again; entries can be reviewed and corrected before submission, and the process can be cancelled at any time. By clicking the payment button, the user makes a binding offer; the contract is concluded as soon as the Operator credits the Taler after payment has been confirmed. The contract languages are German and English. The Operator stores the order data and sends the user a confirmation of the contract by email. These Terms are available on the website at any time and can be saved or printed.

Payment: Payment is made exclusively by credit or debit card via Stripe Checkout, a service of Stripe Payments Europe, Limited (Dublin, Ireland). The price is due immediately upon submission of the order. The user enters card details directly with Stripe; the Operator neither receives nor stores them.

Section 14a – Taler

Taler are a virtual in-game currency. They grant a non-transferable right to redeem them within the Game for the game content offered there. Taler are tied to the account for which they were purchased; they cannot be transferred between accounts or passed on to third parties, and they cannot be exchanged for money or other means of payment or paid out.

The Taler are credited to the account immediately after Stripe confirms the payment; there is no delivery. If the Taler have not been credited within 24 hours, the user should contact office@vidiscope.com, stating the order ID. The statutory rights where digital content is not provided or not provided in conformity with the contract (Sections 327 et seq. BGB) remain unaffected.

Refunds: In the event of an incorrect charge for which the Operator is responsible (e.g. duplicate charge, incorrect amount), the Operator will refund the overpaid amount via Stripe to the original means of payment and deduct any Taler credited for it. Otherwise, no refunds are made; the right of withdrawal (Section 15) and statutory rights remain unaffected. If the user reverses a payment (chargeback), the Operator will deduct the corresponding Taler; if this results in a negative Taler balance, the Operator may suspend the account until the matter has been resolved.

If the account is legitimately suspended permanently or deleted (Section 7) because of a serious breach of these Terms for which the user is responsible, any Taler not used at that time are forfeited without refund. In the event of a temporary suspension, the Taler balance is retained. If the user deletes their account themselves, any unused Taler are likewise forfeited; the user will be informed of this before deletion.

The Operator may discontinue operation of the Game as a whole with at least three months' notice; the discontinuation will be announced in the Game and by email. From the time of the announcement, no further Taler will be sold; Taler already purchased can be redeemed in the Game until it is discontinued. There is no entitlement to a refund of Taler unused at the time of discontinuation. The right to discontinue the Game without notice for good cause for which the Operator is not responsible (e.g. an official prohibition) and the user's statutory rights remain unaffected.

Taler purchases are only permitted for users of legal age; minors aged 16 or over may only purchase Taler with the consent of their parent or legal guardian. By purchasing, the user confirms that these requirements are met and that they are authorised to use the means of payment used.

Section 15 – Right of Withdrawal

Consumers have a statutory right of withdrawal when purchasing Taler packs. It expires early if, before the purchase, the user has expressly agreed that the Operator begins performance of the contract before the withdrawal period expires, has confirmed their knowledge that the right of withdrawal is thereby lost, and the Operator has provided a confirmation of the contract (Section 356(5) BGB). There is no right of withdrawal for the free use of the Game; the terms-of-use agreement can be ended at any time by deleting the account.
